\u201c\u2026On the 1st of October 1999 Terence Mac Carthy officially wrote\nto me: \u201cBeing unwell, and unable to exercise the Office of President\nof The International Commission for Orders of Chivalry I now resign\nthe said Office confirming you as my successor.\u201d<\/p>\n\n\n\n
At first I want to controll again the effective scientific competence of every ICOC Commissioners, <\/em><\/p>\n\n\n\n and (according to Statutes) I will confirm in their\nposition only those persons who are really scientific experts in Chivalric matter!!! I will do many changes in ICOC!...\u201d<\/em><\/p>\n\n\n\n pag. 4\/18<\/p>\n\n\n\n \u201c\u2026In the era of the Kingdom of Italy it was therefore a city famous\nfor numerous and competent judgments in matters of heraldry,\ngenealogy and nobility\u2026\u201d<\/em><\/p>\n\n\n\n INCREDIBLE! No academic historian had ever discovered this\nprerogative of Casale Monferrato, a doctored \u201ctrouvaille\u201d of the\n\u201cCount of Cavagli\u00e0\u201d!!!<\/strong><\/p>\n\n\n\n \"...<\/em>\u201c\u2026WHY AN ITALIAN ARBITRATION RULING?<\/em><\/strong> <\/em><\/p>\n\n\n\n It is easy to\nunderstand! Because in Italy the coat of arms of a private person\ncannot be recognized officially by the Ufficio Araldico dello Stato.\nMany persons, both Italian and foreign, are willing to make it\nrecognized and protected in some legal way both in Italy and in\nthose countries where does exists the possibility to \u201cdelibare\u201d it (that\nmeans make it executive), so giving the coat of arms a juridical\nvalue which comes from a legal authority. <\/em><\/p>\n\n\n\n Besides this is an\nundirect recognition with full juridical value ratified by the\nMagistrature, that is an act wich has complete legal value, much\nmore than a private admission into a dynastic order or nobiliary\nconfraternity or nobiliary corporation which asks proofs of nobility\nand which in front of the State has no official value!!!\u201d<\/em>\u201d.<\/p>\n\n\n\n Pag. 5\/18<\/p>\n\n\n\n \u201cTHE ITALIAN ARBITRATION RULINGS MacCARTHY MOR vs. HORAK <\/em><\/strong><\/p>\n\n\n\n The rulings in the case of MacCarthy M\u00f3r vs. Horak are judge\u2019s arbitrations, completely valid from a judicial and legal point of view, and which have value for the parties. <\/em><\/p>\n\n\n\n According to Italian Law they are based SOLELY on the right to the use of a coat of arms (the Italian Republic in this case does not recognize anything beyond the right of the name, which may be represented by a coat of arms because the coat of arms is ONLY, in the Italian Republic,\nthe graphical expression of the name or, if we would look at the matter from a different point of view, a trade mark). <\/em><\/p>\n\n\n\n <\/p>\n\n\n\n <\/p>\n<\/div><\/div>\n\n\n\n Unfortunately, the concept of Italian judgment has often been considered as a sort of discredit\u2026 but I must underline once again that this is just a clich\u00e9 like many others that I could name for English, Irish, German, French or Spanish cases!<\/em>\u201d Pag 11\/18<\/p>\n\n\n\n \u201cRATIONALE FOR CHOOSING ITALY FOR THE JUDGMENT OF\nMacCARTHY MOR vs. HORAK<\/p>\n\n\n\n I consider it logical that the arbitration proceedings were undertaken in Italy, since the defendant, Dr. Horak, is an Italian citizen. <\/em><\/p>\n\n\n\n Besides, I do not consider\nstrange that Ireland (where the plaintiff was completely recognized)\nwas not chosen and Italy was preferred, because 1) we are going to\na complete European Community; 2) many other verdicts about\nnobility, genealogy and heraldry are issued in France, Spain,\nSMOM and (until few years ago) in the Republic of Saint Marino\netc\u2026 and these verdicts are about nobility, genealogy and heraldry\nnot always pertaining to those same countries where they are\nissued.\u201d<\/em><\/p>\n\n\n\n \"...<\/em>\u201cTHE JUDGES AND THE DEFENDANT <\/em><\/strong><\/p>\n\n\n\n The judges in the case of\nMacCarthy M\u00f3r vs. Horak were: Dr. Roberto Messina; Dr. Riccardo\nPinotti and Dr. Bianca Maria Rusconi, all persons scientifically\ncompetent in nobiliary rights according to the laws at the time they\nexisted in the Kingdom of Italy, and equally competent in heraldic\nrights, which refer to the right to a coat of arms as an extension of\nthe name. <\/em><\/p>\n\n\n\n In addition, Dr. Horak is an earnest man, competent in\nnobiliary, heraldic and genealogical matters. <\/em><\/strong><\/p>\n<\/div> Dr. Robert Messina,\nDr. Bianca Maria Rusconi and Dr. Marco Horak are three of my best\nfriends, while Dr. Riccardo Pinotti is my father-in-law. I want to\nstress that none of them are members of the Niadh Nask, nor have\nthey received compensation of any sort for the judgment of\n\nMacCarthy M\u00f3r vs. Horak.<\/p>\n\n\n\n The fact that they are all my friends, I\nbelieve, could not have in any way had an influence on their\nobjective judgment, and because (as I have said) they had been\nprovided with a pile of some 2,500 documents, among which many\nwere of official recognition originating from the authority of States!\u201d<\/em><\/p>\n\n\n\n \"Honestly, it seems a ridiculous and childish interpretative tinkering with the validity of the judgment..play with simple allusions or inferences to sustain a vague atmosphere of doubt or discredit\u2026\u201d<\/em><\/p>\n\n\n\n Il degli Uberti gi\u00e0 Ubertis gi\u00e0 No\u00e8 nel 1999 si lagnava del fatto che le osservazioni di studiosi indipendenti inerenti la terna arbitrale \u201cdi suoi amici\u201d fosse una mera operazione malevola per gettare il dubbio o il discredito sulla operazione \u201cLodo Casalese\u201d. <\/strong><\/p>\n\n\n\n But, surprise!!! In February 2025, the degli Uberti - Ubertis - No\u00e8\nstates, writing publicly on Facebook: "... that arbitral awards were\nthe only way to save Horak from a Terence MacCarthy lawsuit for\ndefamation by playing on ignorance of Italian law... Terence [is] Irish\ntrusted what was said and like you [he is addressing an interlocutor,\ned. I used to work with the Heraldic Office of Ireland because I was\nAIH [Acad\u00e9mie Internationale d'H\u00e9raldique \/ The International\nAcademy of Heraldry, ed.] ...."<\/p>\n<\/div><\/div>\n\n\n\n Pag. 13 <\/p>\n\n\n\n But the sentences of MacCarthy M\u00f3r vs. Horak really have nothing to do with the opinions of those sentences\nexpressed by Mr. Sean Murphy MA of the Centre for Irish Genealogical and Local Studies or others, which\nhave all been written in an incompetent manner without having read the entire sentences (otherwise they have\nunderstood them to be ANOTHER THING ENTIRELY!). I remind you again that the arbitration rulings of\nwhich we speak deal with the right to a coat of arms as a graphical expression of the name!<\/p>\n\n\n\n Pag 14\/18<\/p>\n\n\n\n \u201c\u2026In spite of what you erroneously wrote on the NN, in the verdict it\nis considered only as: \u201c..una corporazione o confraternit\u00e0 in pratica\ncome una Corporazione nobiliare che raccoglie Gentiluomini\npossessori di stemma\u2026 In merito agli articoli 7-8 della Legge 3\nmarzo 1951, \u00e8 ovvio che il NIADH NASK, data la sua natura di\nOrdine non cavalleresco e neppure di Decorazione di natura\ncavalleresca nel senso e negli intendimenti conosciuti e a cui si\nispira la Repubblica Italiana, dovendosi considerare un Onore di\ncontenuto Dinastico sorto in un epoca nella quale non esistevano\ngli Ordini cavallereschi come vengono intesi secondo i dettami della\nlegge in questione, per la sua natura e per i suoi scopi non pu\u00f2 e\nnon deve considerasi soggetto ai dettami di tale Legge\u201d.<\/p>\n\n\n\n In Italian\nthe word \u201cORDER\u201d means a group of persons which constitute a\nparticular category with common characteristics! For example: the\nOrder of Engineers, Order of Physicians\u2026 but also the Order of the\nKnights of the Lands of Alba (Ordine dei Cavalieri delle Terre\nd\u2019Alba) which is an association with enological-gastronomic\npurposes\u2026\u00a0\u00bb<\/em><\/p>\n\n\n\n I am sorry but Mr degli Uberti \u2013 formerly Ubertis formerly No\u00e9 \u2013\nis absolutely off the mark. In Italy (and Europe) a \u201cProfessional\nOrder\u201d is a Public Body subsidiary of the State, whose main\nfunction is to guarantee the citizen about the professionalism\nand competence of the registered professionals, who carry out\nthe relevant professional activities according to the law of the\nart, and possess the necessary academic qualifications.\nHowever, this does not apply to the Knights of the Lands of\nAlba, which is not a Professional Order, and one wonders\nabout the legitimacy of this order in light of the 1951\nregulation. <\/strong><\/p>\n\n\n\n \u00ab\u00a0\u00a0Please I pray you to read the Italian text and undestand it in\njuridical manner!\u201d wrote Mr degli Uberti formerly Ubertis formerly\nNo\u00e9: And, therefore, now WE READ IT!<\/p>\n\n\n\n Here is the verdict of the famous award number ONE<\/strong><\/p>\n\n\n\n Having recovered the text of the Arbitral Awards Mac Carthy vs\nHorak (published in its entirety in the previous section and\ndownloadable in PDF), let us read its conclusions:<\/p>\n\n\n\n pag. 3 e 4 <\/p>\n\n\n\n ...we recognise the right to place on the noble arms of the\nNiadh Nask ...(in Italian Military Order of the Golden Necklace)\nthe ancient crown of Munster inherent in the status due to\nTerence Francis MacCarthy ...as head in name and arms of the\nRoyal House of Munster...<\/em><\/strong><\/p>\n\n\n\n Here is the verdict of the famous Lodo Number TWO<\/strong><\/p>\n\n\n\n Pg 54 "...be proved chivalry in Gaelic Ireland prior to the Anglo-\nNorman invasion of 1169, and hence the existence of the Niadh\nNask or Military Order of the Golden Chain ... (a dynastic order\nof a non-chivalric nature) ...<\/em><\/strong><\/p>\n\n\n\n This first conclusion, to quote Fantozzi in his famous film: \u2018IT'S\nA CRAZY SHIT\u2019, it is enough to consider that no scientific text\nof the most quoted medievalists even remotely reaches such\nbold conclusions. <\/strong><\/p>\n\n\n\n Pg 55 "... to be therefore considered the Niadh Nask in the\ninternational sphere as a dynastic order in the Royal House of\nMunster, the title of Prince Desmond with all the prerogatives\nlegally assigned to him, including full possession of the FONS\nHONORUM with the absolute ownership of the Niadh Nask...<\/em><\/strong><\/p>\n\n\n\n \u2018...the Republic of Ireland, in accepting the English Common\nLaw as the sole basis of its legal code, can in no way claim\njurisdiction in a matter under Behon law...\u2019<\/em><\/strong><\/p>\n\n\n\n Page 57 \u2018...vest in the plaintiff Terence MacCarthy ...the full\nexercise of the two rights of JUS MAJESTATIS and JUS\nHONORUM constituting the prerogative of FONS HONORUM...\u2019 <\/em><\/strong><\/p>\n\n\n\n As can be seen, the two Casalese judgements, contrary to what\nwas written by degli Uberti formely Ubertis formely No\u00e9, did NOT\nconcern a mere question of \u2018coat of arms as a graphic expression of\n\nthe surname\u2019, but represented a titanic effort by degli Uberti formelly\nUbertis formelly No\u00e9, and his sodalists and associates, to recognise\nin the head of their sodalist MacCarthy the prerogatives of FONS\nHONORUM, allowing him to grant Irish noble titles (in fact Alfredo\nNo\u00e9 and Pier Felice will take two titles of Lord - ref: Niadh Nask\n1999), and to be able to grant the Niadh Nask, taking great care not\nto fall under the prohibitions of the Italian law of 1951 that forbids\nunauthorised grants of knighthood.<\/p>\n\n\n\n Reducing the two praises to a mere juridical exercise to confirm a\ncoat of arms, as degli Uberti formerly Ubertis formerly No\u00e9 claimed\nin writing in 1999, is blatantly contradicted by the contents of the\npraises themselves. Similarly, to claim, as the same degli Uberti\nformely Ubertis formely No\u00e8 does today, that he used the awards\nfor improper purposes, \u2018Terence the Irish trusted what was said\nand, like you, he was fooled by arbitration awards that are\nworth nothing...\u2019 is simply shameful.<\/p>\n\n\n\n Whether the first version is true, or the second, what emerges is an\nindecent, morally and ethically squalid spectacle.<\/strong><\/p>\n\n\n\n Let us add that, in 2007, the famous \u201cMac Carthy Mor Prince of\nDesmond\u201d repaired to Tangier, Morocco, as Sean J. Murphy, MA\n(Centre for Irish Genealogical and Historical Studies) writes. His\ntrail was then lost.<\/p>\n\n\n\n Only a few considerations remain for us:<\/strong><\/p>\n\n\n\n - this judicial affair made a mockery of the Italian justice system\nand made Casale Monferrato known to the world as the epicentre of the most tragicomic judicial bluff in matters of\nchivalry, nobility to say the least. <\/p>\n\n\n\n The group of sodalists of degli Uberti-Ubertis-No\u00e8 managed to\ndeclare that, in Italy, these noble matters must only be dealt\nwith in a court of the Republic by a college \u201cof Peers\u201d (!!); <\/p>\n\n\n\n managed to deny Ireland's jurisdiction over its territory and its\ncitizens, the stuff of diplomatic incident!<\/strong>, roba da incidente diplomatico!;<\/p>\n\n\n\n have created\/recognised\/attempted to validate a fons honorum\nbased on a lord (MacCarthy) who was structural to their own\ngroup, all conducted with a use of justice worthy of a plot by\nthe great Scarpetta, even going so far as to invent a Spanish\norigin for the lords of Desmond, more Irish than the\nshamrocks, so as to implicate the herald of Castile and Leon,\nAlfonso de Ceballos Escalera y Gila, who blamelessly\nfabricated a certification of coat of arms, genealogy and title!<\/p>\n\n\n\n But this is not enough! To justify this tragic affair, today, the Degli\nUberti already Ubertis already No\u00e8, claims it was all a sham "... that\narbitral awards were the only way to save Horak from a lawsuit\nby Terence MacCarthy for defamation by playing on his\nignorance of Italian law... Terence [is] Irish trusted what was\nsaid and like you [he is addressing an interlocutor, ed. d.r.] he\nwas fooled by arbitration awards that are worth nothing...'. But\nit was not so in 1999 where the \u201cworld's leading expert\u201d issued an\nofficial statement, in English, which we have retrieved and quote\nverbatim.already<\/p>\n\n\n\n So we feel it is only right to ask: <\/p>\n\n\n\n -Mr Degli Uberti, do you really have the courage to claim that you\nthought up, wrote and fabricated a judgement that is invalid for its\ncontents, having it deliberated by a magistrate of the Italian\nRepublic, thus making a mockery of the administration of justice?<\/p>\n\n\n\n -But do you really confess to having deceived Italian justice,\nbending it to a ridiculous arbitration award that has only brought the\nentire Italian judicial system into disrepute throughout the world,\nand this for your own inscrutable purposes? <\/p>\n\n\n\n The suspicion that arises is one: the ICOC's scheme was to clear,\ninitially, the Order of St. Lazarus, whose legitimacy is doubtful\nconsidering the literature on the point, thanks to its president Gayre\nof Gayre and Nygg (a fake Scottish baron and illegitimate son who\nbore his mother's surname)\nhttps:\/\/www.patrickcomerford.com\/2020\/07\/robert-gair-racist-from-\nrathmines-who.html.\nThen, under the presidency of MacCarthy (fake Irish prince of false\nroyal descent from labourers) the ICOC, with the Casalese award,\ntried to clear the order of the Niad Nask (Golden Necklace) ... Years\npass, protagonists change, but the modes of action of this \u201ccoven\u201d\nremain the same. A next chapter will be devoted to the ICOC and\nits protagonists.<\/p>\n\n\n\n One would think that the same system applies, even today, to\nlegitimise the Order of Vitez under the chairmanship of the Ubertis\nformerly No\u00e9, president of the ICOC for over 25 years. Through the\ndecades, the ICOC has not lost its nature and, with extreme\n\nconsistency, has had three presidents with fictitious genealogies\nand all of them fake nobles.
