Chapter 5: Arbitration ruling - Court of Casale Monferrato - Ireland - Marocco


In 1999, degli Uberti formerly Ubertis formerly Noé produced an official communiqué, as the newly appointed ICOC President, in English, obviously addressed only to the Anglo-Saxon world, in which he tried to explain the reasons for the Casale award and, at the same time, attempt to put a stop to the scandal that was engulfing the castle of MacCarthy and his associates, as we will later explain.

We reproduce the full text above; now let us summarise the salient points of the “Ubertian” defence, at the time newly appointed President of ICOC, precisely because of the ‘succession’ arranged by MacCarthy (!)

“…On the 1st of October 1999 Terence Mac Carthy officially wrote to me: “Being unwell, and unable to exercise the Office of President of The International Commission for Orders of Chivalry I now resign the said Office confirming you as my successor.”

At first I want to controll again the effective scientific competence of every ICOC Commissioners, 

and (according to Statutes) I will confirm in their position only those persons who are really scientific experts in Chivalric matter!!! I will do many changes in ICOC!...”

“…In the era of the Kingdom of Italy it was therefore a city famous for numerous and competent judgments in matters of heraldry, genealogy and nobility…”

INCREDIBLE! No academic historian had ever discovered this prerogative of Casale Monferrato, a doctored “trouvaille” of the “Count of Cavaglià”!!!

"...“…WHY AN ITALIAN ARBITRATION RULING? 

It is easy to understand! Because in Italy the coat of arms of a private person cannot be recognized officially by the Ufficio Araldico dello Stato. Many persons, both Italian and foreign, are willing to make it recognized and protected in some legal way both in Italy and in those countries where does exists the possibility to “delibare” it (that means make it executive), so giving the coat of arms a juridical value which comes from a legal authority.  

Besides this is an undirect recognition with full juridical value ratified by the Magistrature, that is an act wich has complete legal value, much more than a private admission into a dynastic order or nobiliary confraternity or nobiliary corporation which asks proofs of nobility and which in front of the State has no official value!!!””.

“THE ITALIAN ARBITRATION RULINGS MacCARTHY MOR vs. HORAK 

The rulings in the case of MacCarthy Mór vs. Horak are judge’s arbitrations, completely valid from a judicial and legal point of view, and which have value for the parties. 

According to Italian Law they are based SOLELY on the right to the use of a coat of arms (the Italian Republic in this case does not recognize anything beyond the right of the name, which may be represented by a coat of arms because the coat of arms is ONLY, in the Italian Republic, the graphical expression of the name or, if we would look at the matter from a different point of view, a trade mark). 

Unfortunately, the concept of Italian judgment has often been considered as a sort of discredit… but I must underline once again that this is just a cliché like many others that I could name for English, Irish, German, French or Spanish cases!

“RATIONALE FOR CHOOSING ITALY FOR THE JUDGMENT OF MacCARTHY MOR vs. HORAK

I consider it logical that the arbitration proceedings were undertaken in Italy, since the defendant, Dr. Horak, is an Italian citizen. 

Besides, I do not consider strange that Ireland (where the plaintiff was completely recognized) was not chosen and Italy was preferred, because 1) we are going to a complete European Community; 2) many other verdicts about nobility, genealogy and heraldry are issued in France, Spain, SMOM and (until few years ago) in the Republic of Saint Marino etc… and these verdicts are about nobility, genealogy and heraldry not always pertaining to those same countries where they are issued.”

"...“THE JUDGES AND THE DEFENDANT 

The judges in the case of MacCarthy Mór vs. Horak were: Dr. Roberto Messina; Dr. Riccardo Pinotti and Dr. Bianca Maria Rusconi, all persons scientifically competent in nobiliary rights according to the laws at the time they existed in the Kingdom of Italy, and equally competent in heraldic rights, which refer to the right to a coat of arms as an extension of the name. 

In addition, Dr. Horak is an earnest man, competent in nobiliary, heraldic and genealogical matters. 

Dr. Robert Messina, Dr. Bianca Maria Rusconi and Dr. Marco Horak are three of my best friends, while Dr. Riccardo Pinotti is my father-in-law. I want to stress that none of them are members of the Niadh Nask, nor have they received compensation of any sort for the judgment of MacCarthy Mór vs. Horak.

The fact that they are all my friends, I believe, could not have in any way had an influence on their objective judgment, and because (as I have said) they had been provided with a pile of some 2,500 documents, among which many were of official recognition originating from the authority of States!”

"Honestly, it seems a ridiculous and childish interpretative tinkering with the validity of the judgment..play with simple allusions or inferences to sustain a vague atmosphere of doubt or discredit…”

Il degli Uberti già Ubertis già Noè nel 1999 si lagnava del fatto che le osservazioni di studiosi indipendenti inerenti la terna arbitrale “di suoi amici” fosse una mera operazione malevola per gettare il dubbio o il discredito sulla operazione “Lodo Casalese”. 

But, surprise!!! In February 2025, the degli Uberti - Ubertis - Noè states, writing publicly on Facebook: "... that arbitral awards were the only way to save Horak from a Terence MacCarthy lawsuit for defamation by playing on ignorance of Italian law... Terence [is] Irish trusted what was said and like you [he is addressing an interlocutor, ed. I used to work with the Heraldic Office of Ireland because I was AIH [Académie Internationale d'Héraldique / The International Academy of Heraldry, ed.] ...."

But the sentences of MacCarthy Mór vs. Horak really have nothing to do with the opinions of those sentences expressed by Mr. Sean Murphy MA of the Centre for Irish Genealogical and Local Studies or others, which have all been written in an incompetent manner without having read the entire sentences (otherwise they have understood them to be ANOTHER THING ENTIRELY!). I remind you again that the arbitration rulings of which we speak deal with the right to a coat of arms as a graphical expression of the name!

“…In spite of what you erroneously wrote on the NN, in the verdict it is considered only as: “..una corporazione o confraternità in pratica come una Corporazione nobiliare che raccoglie Gentiluomini possessori di stemma… In merito agli articoli 7-8 della Legge 3 marzo 1951, è ovvio che il NIADH NASK, data la sua natura di Ordine non cavalleresco e neppure di Decorazione di natura cavalleresca nel senso e negli intendimenti conosciuti e a cui si ispira la Repubblica Italiana, dovendosi considerare un Onore di contenuto Dinastico sorto in un epoca nella quale non esistevano gli Ordini cavallereschi come vengono intesi secondo i dettami della legge in questione, per la sua natura e per i suoi scopi non può e non deve considerasi soggetto ai dettami di tale Legge”.

In Italian the word “ORDER” means a group of persons which constitute a particular category with common characteristics! For example: the Order of Engineers, Order of Physicians… but also the Order of the Knights of the Lands of Alba (Ordine dei Cavalieri delle Terre d’Alba) which is an association with enological-gastronomic purposes… »

I am sorry but Mr degli Uberti – formerly Ubertis formerly Noé – is absolutely off the mark. In Italy (and Europe) a “Professional Order” is a Public Body subsidiary of the State, whose main function is to guarantee the citizen about the professionalism and competence of the registered professionals, who carry out the relevant professional activities according to the law of the art, and possess the necessary academic qualifications. However, this does not apply to the Knights of the Lands of Alba, which is not a Professional Order, and one wonders about the legitimacy of this order in light of the 1951 regulation. 

«  Please I pray you to read the Italian text and undestand it in juridical manner!” wrote Mr degli Uberti formerly Ubertis formerly Noé: And, therefore, now WE READ IT!

Here is the verdict of the famous award number ONE

Having recovered the text of the Arbitral Awards Mac Carthy vs Horak (published in its entirety in the previous section and downloadable in PDF), let us read its conclusions:

pag. 3 e 4 

...we recognise the right to place on the noble arms of the Niadh Nask ...(in Italian Military Order of the Golden Necklace) the ancient crown of Munster inherent in the status due to Terence Francis MacCarthy ...as head in name and arms of the Royal House of Munster...

Here is the verdict of the famous Lodo Number TWO

Pg 54 "...be proved chivalry in Gaelic Ireland prior to the Anglo- Norman invasion of 1169, and hence the existence of the Niadh Nask or Military Order of the Golden Chain ... (a dynastic order of a non-chivalric nature) ...

This first conclusion, to quote Fantozzi in his famous film: ‘IT'S A CRAZY SHIT’, it is enough to consider that no scientific text of the most quoted medievalists even remotely reaches such bold conclusions. 

Pg 55 "... to be therefore considered the Niadh Nask in the international sphere as a dynastic order in the Royal House of Munster, the title of Prince Desmond with all the prerogatives legally assigned to him, including full possession of the FONS HONORUM with the absolute ownership of the Niadh Nask...

‘...the Republic of Ireland, in accepting the English Common Law as the sole basis of its legal code, can in no way claim jurisdiction in a matter under Behon law...’

Page 57 ‘...vest in the plaintiff Terence MacCarthy ...the full exercise of the two rights of JUS MAJESTATIS and JUS HONORUM constituting the prerogative of FONS HONORUM...’   

As can be seen, the two Casalese judgements, contrary to what was written by degli Uberti formely Ubertis formely Noé, did NOT concern a mere question of ‘coat of arms as a graphic expression of the surname’, but represented a titanic effort by degli Uberti formelly Ubertis formelly Noé, and his sodalists and associates, to recognise in the head of their sodalist MacCarthy the prerogatives of FONS HONORUM, allowing him to grant Irish noble titles (in fact Alfredo Noé and Pier Felice will take two titles of Lord - ref: Niadh Nask 1999), and to be able to grant the Niadh Nask, taking great care not to fall under the prohibitions of the Italian law of 1951 that forbids unauthorised grants of knighthood.

Reducing the two praises to a mere juridical exercise to confirm a coat of arms, as degli Uberti formerly Ubertis formerly Noé claimed in writing in 1999, is blatantly contradicted by the contents of the praises themselves. Similarly, to claim, as the same degli Uberti formely Ubertis formely Noè does today, that he used the awards for improper purposes, ‘Terence the Irish trusted what was said and, like you, he was fooled by arbitration awards that are worth nothing...’ is simply shameful.

Whether the first version is true, or the second, what emerges is an indecent, morally and ethically squalid spectacle.

Let us add that, in 2007, the famous “Mac Carthy Mor Prince of Desmond” repaired to Tangier, Morocco, as Sean J. Murphy, MA (Centre for Irish Genealogical and Historical Studies) writes. His trail was then lost.

Only a few considerations remain for us:

- this judicial affair made a mockery of the Italian justice system and made Casale Monferrato known to the world as the epicentre of the most tragicomic judicial bluff in matters of chivalry, nobility to say the least. 

The group of sodalists of degli Uberti-Ubertis-Noè managed to declare that, in Italy, these noble matters must only be dealt with in a court of the Republic by a college “of Peers” (!!); 

managed to deny Ireland's jurisdiction over its territory and its citizens, the stuff of diplomatic incident!, roba da incidente diplomatico!;

have created/recognised/attempted to validate a fons honorum based on a lord (MacCarthy) who was structural to their own group, all conducted with a use of justice worthy of a plot by the great Scarpetta, even going so far as to invent a Spanish origin for the lords of Desmond, more Irish than the shamrocks, so as to implicate the herald of Castile and Leon, Alfonso de Ceballos Escalera y Gila, who blamelessly fabricated a certification of coat of arms, genealogy and title!

But this is not enough! To justify this tragic affair, today, the Degli Uberti already Ubertis already Noè, claims it was all a sham "... that arbitral awards were the only way to save Horak from a lawsuit by Terence MacCarthy for defamation by playing on his ignorance of Italian law... Terence [is] Irish trusted what was said and like you [he is addressing an interlocutor, ed. d.r.] he was fooled by arbitration awards that are worth nothing...'. But it was not so in 1999 where the “world's leading expert” issued an official statement, in English, which we have retrieved and quote verbatim.already

So we feel it is only right to ask: 

-Mr Degli Uberti, do you really have the courage to claim that you thought up, wrote and fabricated a judgement that is invalid for its contents, having it deliberated by a magistrate of the Italian Republic, thus making a mockery of the administration of justice?

-But do you really confess to having deceived Italian justice, bending it to a ridiculous arbitration award that has only brought the entire Italian judicial system into disrepute throughout the world, and this for your own inscrutable purposes? 

The suspicion that arises is one: the ICOC's scheme was to clear, initially, the Order of St. Lazarus, whose legitimacy is doubtful considering the literature on the point, thanks to its president Gayre of Gayre and Nygg (a fake Scottish baron and illegitimate son who bore his mother's surname) https://www.patrickcomerford.com/2020/07/robert-gair-racist-from- rathmines-who.html. Then, under the presidency of MacCarthy (fake Irish prince of false royal descent from labourers) the ICOC, with the Casalese award, tried to clear the order of the Niad Nask (Golden Necklace) ... Years pass, protagonists change, but the modes of action of this “coven” remain the same. A next chapter will be devoted to the ICOC and its protagonists.

One would think that the same system applies, even today, to legitimise the Order of Vitez under the chairmanship of the Ubertis formerly Noé, president of the ICOC for over 25 years. Through the decades, the ICOC has not lost its nature and, with extreme consistency, has had three presidents with fictitious genealogies and all of them fake nobles. But more on this in the next chapters.

It goes without saying that it is enough to read the roles published here, relating to the fake Order of Niad Nask, to find the names of Alfredo degli Uberti, his son Pier Felice, his companion Maria Loredana Pinotti, and other protagonists of this huge judicial scandal, all decorated with this fake order and fake “noble titles”. With all due respect to the “world's foremost expert on nobiliary law, heraldry and genealogy” who, today, answers to the name of degli Uberti: the only truly worldly thing is the disgrace that Italy and Casale Monferrato have suffered because of these figures. 


I assume that the Major of Casale Monferrato, Emanuele Capra, who takes part of the cerimonies of the "Count of Cavaglià" and "Lord of Waterville" with the italian stripe has no idea of these facts
